Alina Habba has stepped down as New Jersey's top federal prosecutor. This follows a court battle that questioned her right to hold the office.

Official Departure

US Attorney General, Pam Bondi, accepted her stepping down on Monday. She commented that the judicial decision made it "untenable" for the official to lead the department effectively.

"Let no one confuse compliance for surrender," Habba stated. "The effort will now extend throughout America."

Court Ruling

Habba's exit comes a week after a US appeals court ruled that she had been serving in violation of the law as US attorney. This judgment is expected to impact many legal proceedings in the Garden State.

The judicial panel declared that a interim role that did not receive Senate approval violated the Federal Vacancies Reform Act.

Next Steps and Responses

It was also stated that she will continue working within the justice department as a senior adviser. Habba plans to pursue additional appeals of the disqualification, with hopes of a reversal.

On a social media platform, the Attorney General contended that judges "cannot be permitted to second-guess the executive's selection of prosecutors tasked with performing the fundamental role of the presidency of enforcing the law."

The attorney general highlighted the prosecutor's work and noted that during her run, the city of Newark saw a significant drop in criminal activity. Additionally that the Camden recorded its first summer in 50 years without a homicide.

Connection to Donald Trump

Habba, 41, first joined Trump's personal legal team in recent years. She later represented her client in his business records case in New York last year, when he was conviction on 34 counts of document fraud.

Prior to assuming the federal prosecutor position, Donald Trump had stated he was selecting her as his presidential counsellor during his second administration, calling the lawyer as deeply loyal and a dedicated fighter for justice.
